Proclamation “Guaranteeing the States Protection Against Invasion” Bars Asylum Seekers and Others from Entry at the Southern Border

On January 20, the Administration declared an “invasion” of migrants at the U.S.-Mexico border. The Proclamation allows the Administration to suspend the physical entry of individuals into the United States across the southern border. As part of the Proclamation, the Administration signaled that it would halt asylum applications and other forms of relief for individuals crossing the southern border. Additionally, entry will be denied to anyone unable to provide sufficient medical, criminal history, or background information, citing public health and national security concerns.

“This action directly contradicts U.S. law, which guarantees the right of individuals in the United States or at its borders to apply for asylum,” said Negash. “Combined with other efforts to suspend the refugee program indefinitely, this reflects a departure from the United States’ role as a moral leader. Hundreds of families, children, and individuals fleeing harm will undoubtedly be turned back to face greater danger and even death.”

USCRI urges the Administration to restore full access to the asylum system as mandated by law. Rather than barring individuals from seeking safety, the United States should uphold its legal and moral obligations by protecting the rights and well-being of those seeking refuge at our borders.
