USCRI Tijuana – Reinstating Visitor’s Card for Humanitarian Reasons

In 2023, the National Institute of Migration took the decision to suspend the issuance of Visitor’s Cards for Humanitarian Reasons; this eventually resulted in a failure to comply with its legal obligations and, therefore, in the constant and repeated violation of the Human Rights of the applicants. This identification document is essential for the population in the context of mobility since it allows them, among other things, to access health services, education and, above all, to stay regularly within Mexican territory. 

This card is issued to any person requesting recognition of refugee status before the Mexican Commission for Refugee Assistance; the issuance is due to the fact that the National Migration Institute is legally obliged to issue these documents to any person who has an active case before COMAR. Therefore, the refusal of the Mexican authority to deliver this document results in an attack against the applicants, which translates into a series of severe consequences.

As a result, the legal team of USCRI Latin America and the Caribbean, through its Tijuana office, began implementing various legal strategies, which resulted in the initiation of several federal lawsuits against the immigration authority for the violation of the human rights of the community in the context of mobility. Thanks to the legal efforts, a federal judge ordered the National Institute of Migration to issue the Visitor’s Card for Humanitarian Reasons in favor of our clients, recognizing that there were a series of human rights violations; achieving, so far, the order of issuance of 4 cards in favor of our clients.
