Administration Enroute to Institute a Transit Ban on Asylum and Expand the Use of Expedited Removal: USCRI Urges the Administration to Reverse Course

February 9, 2023

In a filing with the U.S. Supreme Court earlier this week, the current administration moved forward with its intent to “place additional conditions on asylum eligibility” after the use of Title 42 ends. This builds upon the January 5 announcement, from the U.S. Department of Homeland Security (DHS), to implement new border enforcement measures.

Despite hundreds of organizations denouncing the move, this most recent action signals that the administration is moving forward with its plans to restrict asylum for individuals who “fail to seek protection in a country through which they traveled on their way to the United States” and will expand the use of expedited removal and fast-tracked asylum screenings.

USCRI, civil society, and member of Congress urged President to reverse the administration’s plans to limit access to asylum and to institute a transit ban.

“This administration has promised time and time again that it will uphold the legal right to asylum,” USCRI President and CEO Eskinder Negash said. “Now is the time to act and expand protections for asylum seekers.”

USCRI urges the current administration to reverse course and instead take steps to ensure fair access to asylum, uphold international and domestic laws to asylum access, and give due process and protections to individuals fleeing persecution and torture.

USCRI, founded in 1911, is a non-governmental, not-for-profit international organization committed to working on behalf of refugees and immigrants and their transition to a dignified life.
